ALLGEMEINE GESCHÄFTSBEDINGUNGEN ( wie auf dem Originalvertrag )

Ich übernehme zur Miete umseitig aufgeführtes Fahrzeug mit Wagenpapieren, Schlüssel, Werkzeug und Reserverad, alles in einwandfreien, fahrbereiten Zustand zu folgenden Benutzungsbedingungen:

1. MIETGEBÜHR: Nach gültiger Preisliste. Im Mietpreis nicht eingeschlossen sind Kraftstoffe, Abschleppkosten, Verkehrsstrafen oder sonstige Zuwiderhandlungen gegen die Straßenverkehrsordnung.
2. MIETDAUER: Von 08:00 Uhr bis 20:00 Uhr des selbigen Tages.
3. ABBESTELLUNGEN: Mindestens 24 Stunden vor Mietbeginn.
4. RÜCKTRITT VOM VERTRAG VOR ABLAUF DER MIETDAUER: Der Vermieter kann jederzeit, ohne Einhaltung einer Frist, vom Vertrag zurücktreten. Dieses Recht behält er sich u.a. dann vor, wenn der Mieter gegen die Vertragsbestimmungen verstößt. Tritt der Mieter vor Vertragsablauf vom Vertrag zurück, hat er keinen Anspruch auf Rückerstattung der Mietgebühr.
5. BEHANDLUNG DES FAHRZEUGES: Der Mieter hat das Fahrzeug schonend zu behandeln. Bei Schäden z.B. an Felgen, Radaufhängungen, Auspuff, Ölwanne, die durch grob fahrlässiges Verhalten, wie Anfahren von Bordsteinen oder anderen Gegenständen entstehen, haftet der Mieter auch bei Vollkasko für alle angefallenen Kosten. Zur Vermeidung dieser Schäden ist es strengstens untersagt die asphaltierten Strassen zu verlassen.
6. Dem Mieter sind ferner untersagt: Beteiligungen an motorsportlichen Veranstaltungen, Verwendung des Wagens zur gewerblichen Personenbeförderung,  Weitervermietung, ungesetzliche Beförderung von Zoll oder sonstigem verbotenen Gut.
7. VERSICHERUNGSSCHUTZ: Der Kunde besitzt mit diesem Vertrag eine Vollkaskoversicherung ohne Selbstbeteiligung sowie eine Insassenschutzversicherung. Jeglicher Versicherungsschutz erlischt jedoch, wenn das Fahrzeug unter Alkoholeinfluss oder starker Übermüdung gefahren wird. Ferner erlischt der Schutz, wenn Schäden aufgrund von Fährlässigkeit und Vorsatz entstanden sind.
8. VERLUST von Wagenpapieren, Schlüssel, Werkzeuge, Zubehör und persönlichen Gegenständen gehen zu Lasten des Mieters. Sollte ein Wagen Einbruchsschäden aufweisen, die entstanden sind, weil der Kunde Sachen im Auto hat liegengelassen, so haftet der Mieter für alle entstandenen Schäden.
9. EIN VERLASSEN DER INSEL ist mit dem gemieteten Fahrzeug nicht gestattet.
10. VERHALTEN BEI UNFÄLLEN: Im Falle eines Unfalls (selbst bei geringfügigen Schäden) ist der Mieter verpflichtet unverzüglich den Vermieter unter den angegebenen Rufnummern anzurufen. Des weiteren muss bei Unfällen umgehend der Tatbestand durch die zuständige Polizei aufgenommen werden. Der im Wagen vorhandene Unfallbericht ist, unter Hinzuziehung des Musters, ordnungsgemäß auszufüllen und von alle Beteiligten zu unterschreiben. Es dürfen keine Verpflichtungen vom Mieter anerkannt werden. Der Wagen darf nur dann stehen gelassen werde, wenn für ausreichende Bewachung und Sicherstellung gesorgt ist.

GENERAL TERMS OF BUSINESS

I agree to rent the above vehicle with car papers, key, complete tool kit and spare wheel, everything in perfect condition and ready to drive and I accept each and all of the following conditions of the present contract:

1. RENTAL FEE: According to valid price list. In the rental charge are not included fuel, cost for being towed off, traffic punishments or other offences against road traffic regulations.
2. RENTAL TIME: From 08:00 to 20:00 of the same day.
3. CANCELLATIONS: At least 24 hours before beginning of renting.
4. CANCELLATION OF THE CONTRACT BEFORE EXPIRATION OF THE RENTAL TIME: The car-hire service can withdraw from the contract at any time without compliance with a period. This right he reserves himself if the tenant offends against the clauses of the contract. If the tenant withdraws from the contract before expiration of the contract, he does not have any claim to get refund of the rental fee.
5. HANDLING OF THE VEHICLE: The tenant has to use the vehicle carefully and in a responsible manner. For any damages caused by gross careless driving for example of the rims, parts of the wheel-suspension, oil sump or exhaust pipe, caused for example by rude running into the kerbstone or other objects the tenant will be made responsible and he must pay for all the relating costs even if there is a comprehensive insurance. In order to avoid those damages it is forbidden to leave the regular, asphalted roads. Besides the tenant must not: take part in motor sports events, use the car for commercial transport, hire the car to others, transport of illegal goods.
6. INSURANCE PROTECTION: The customer possesses an insurance against all risks without self participation as well as a passenger protection insurance with the present contract. Any insurance protection expires, however, if the driver of this vehicle is under influence of alcohol or strong sleepiness. Furthermore, the insurance protection expires, if damages are caused by gross carelessness or intention.
7. LOSS of car papers, keys, tool kit, accessories and personal belongings: In any of these cases the tenant will be made payable. If there should be damages caused by burglary and there were personal belongings left inside the car, the tenant will be made payable for the damages.
8. LEAVING OF THE ISLAND is not permitted with the rented vehicle.
9. BEHAVIOR IN CASE OF ACCIDENTS: In case of an accident (even with slight damage) the renter immediately has to call the car-hire service at the indicated telephone numbers. Furthermore the facts have to be taken to protocol by local police authorities. The accident report form, to be found in the car, is to be filled in correctly according to the sample and has to be signed by all participants. The tenant must not make any commitments. The car may only be left behind when it is in a safe place and sufficient guarding is provided.

CONDICIONES GENERALES

Obtengo en alquiler el coche, que, en el dorso se especifica con papeles, llaves, herramientas y rueda de reserva, todo ello en perfecto estado, bajo las siguentes condiciones:

1. PRECIO DEL ALQUILER: Según la actual lista de precios, en el precio no está incluida la gasolina, gastos de grua, multas de tráfico y otras infracciones de tráfico.
2. DURACIÒN DEL ALQUILER: Desde las 08.00 am hasta las 08.00 pm del mismo día.
3. CANCELACIONES: Toda cancelación de contrato, se hará 24 hora antes del alquiler de dicho vehículo.
4. LA RENUNCIACION AL CONTRATO ANTES DEL VENCIMIENTO DEL CONVENIO: El arrendador puede an cualquier momento, bajo previo aviso cancelar el contrato, es un derecho del arrendador, entre otros, de no cumplirse las condiciones del contrato. En caso de renunciación al contrato por parte de arrendatario, el mismo no tendrá derecho a la devolución del importe ya pagado.
5. UTILIZACIÒN DEL VEHICULO:  El arrendatario tendrá que utilizar el coche con cuidado. En caso de daños como por ejemplo las llantas, el tubo de escape, el cárter, producidos por mal uso del vehículo como golpear contra el borde de las aceras el arrendatario del coche de alquiler tendrá que pagar los gastos de reparacíon, aunque tenga un seguro a todo riesgo. Para evitar estos daños queda totalmente prohibido, salir de las carreteras asfaltadas. Está prohipido también: Tomar parte con el vehículo de algún tipo de carreras, uso del vehículo para el transporte comercial de personas, realquilar el vehículo, el transporte ilegal de mercancía prohibida.
6. SEGURO: Por medio del contrato el cliente obtiene un seguro a todo riesgo sin participacion alguna por parte del cliente. Al igual que un seguro para todos los ocupantes del vehículo. No se obtendrá el seguro en caso de alcoholemia ó por cansancio del conductor. Tampoco cubrirá el seguro los daños causados por negligencia y daños intencionados.
7. PERDIDAS: Perdida de papeles, llaves, herramientas, accesorios y objetos personales correrán a cuenta del arrendatario. En caso de daños causados por robo en el vehículo, por dejar objetos personales dentro de él, los gastos correrán a cuenta del arrendatario.
8. SALIR DE LA ISLA: Queda totalmente prohibida de salir de la isla, con el coche de alquiler.
9. COMPORTAMIENTO EN CASO DE ACCIDENTE: En caso de accidente (también por pequeños desperfectos) el arrendatario está obligado a llamar al arrendador a los números de teléfono que aparecen en la lista. Además deberá informar a la policía. Hay que rellenar el informe de accidente con la ayuda de la muestra que se encuentra dentro del coche. Todos los afectados deberán firmar el formulario. Queda prohibido contraer cualquier compromiso por parte del arrendatario. El vehículo sólo se podrá dejar, en caso de que quede bajo vigilancia.
